Steam Showers & Whirlpool Spas
Atlas International, Inc. offers a three year warranty on steam showers and Whirpool Spas. Ariel Platinum, Royal SSWW and Ameristeam have an additional two years bringing the warranty period to a full five years for these models. The warranty will be void if the unit is not installed by a licensed plumber and electrician. Evidence of installation must be provided at time of warranty claim. The warranty will also become null and void if the unit is used outdoors. The warranty covers all electrical wiring, heating units and control panels. Our steam showers are free of manufacturing and material defects and parts that become defective during the warranty period will be repaired or replaced. The purchaser is responsible for removing the defective parts and returning them to us. The warranty does not cover damage caused by owner neglect, abuse, misuse , non-authorized modifications, incorrect installation, or wear and tear attributable to normal product use.
In order for the warranty to be validated, the purchaser must possess an invoice and delivery slip which indicates the date of product purchase. Replacement parts may take 6-8 weeks for delivery. We are not responsible for and will not reimburse any labour costs arising from disassembling or reassembling the unit for replacement purposes. We are also not responsible for routine maintenance, servicing or electrical alterations to the unit's controls. Any parts that are claimed to be defective must be shipped to our warehouse via a prepaid courier. Please contact us before shipping any parts for delivery information. We are not responsible for lost or missing shipments therefore insure the product is shipped with request for signature. The parts must be accompanied by the original sales receipt or other sales proof of purchase information, as well as the sender's name, mailing address, daytime telephone number and other pertinent claim information. The repaired or replaced parts will be returned to the unit''s owner by collect courier. The warranty only applies to the original purchaser and cannot be transferred, if sold. The warranty becomes void if the purchased unit is used for commercial, industrial or rental purposes. In addition, the warranty does not cover claims arising from misuse, neglect, accidents, abuse, improper installation, or hazards of nature, including excessive exposure to heat or fire. If repairs need to be performed, the purchaser is required to provide access to the unit. The warranty does not cover injuries sustained by anyone in the course of installing or repairing the unit. All costs for removing and reinstalling purchased item including courier/shipping charges shall be at the purchaser's expense.
Regardless of the warranty documentation being returned in the time period specified, there are no warranties or obligations expressed or implied hereunder specifically excluding and implied warranty of merchantability or fitness for a particular purpose other than specifically described herein. No liability shall accrue to Alberta Aquam Home Spas Ltd. except as set forth within.
All warranties are supplied by a third party. Aquam Spas will assist but buyer must work out details with third party as Aquam Spas is not responsible for repairs or parts.
Walk-in Tubs, Showers and Lifts
We do not offer a standard warranty on walk-in bathtubs, showers and lifts due to the diverse manufacturers warranties offered on each unit. Manufacturers warranties vary by manufacturer and the purchaser agrees to abide by the terms and conditions expressed in the manufacturer warranty as well as with these terms and conditions. The warranty will be void if the unit is used outdoors or if it is not installed by a qualified plumber and electrician. In order to validate the warranty the original sales invoice and the original sales slip must accompany the claim. The parts must be removed at the purchasers expense and returned through prepaid courier to the supplier. The purchaser must contact us for current delivery information for the return of parts. The replacement part will be shipped back to the purchaser by collect courier. We are not responsible for any costs related to the installation of the replacement or the re-installation of the original part. We are not responsible for any accidents from the installation of the unit or for any accidents as a result of warranty repairs for or to any person. This warranty will not cover wear and tear, misuse, abuse, modifications or improper installation. No other warranty is implied other than what is described above.
Additional Warranty Information
LIMITED WARRANTY ON AQUAM PRODUCTSAquam Limited Warranty Statement is available to read prior to purchase at http://www.aquamdecor.com/warranty.html. It will also be included with each Aquam product shipped to Customer. Aquam reserves the right to change warranty providers at any time, in its sole discretion, and without notice to Customer. All whirlpool baths, steam showers and saunas carry a 5-year warranty against defects through a third party warranty provider. In the event that a defect develops in one of the parts of an Aquam product, Customer should contact Aquam, who will arrange for a spare part to be delivered to Customer through the warranty provider. EXCEPT FOR THE PROVISION OF REPLACEMENT PARTS TO CUSTOMER DURING THE WARRANTY PERIOD THROUGH THE WARRANTY PROVIDER, AQUAM DOES NOT WARRANTY ANY THIRD PARTY ACCESSORIES OR PRODUCTS. THIRD PARTY SUPPLIER IS SOLELY RESPONSIBLE FOR ALL WARRANTY, SERVICE AND SUPPORT, AND OTHER PRODUCT RELATED ISSUES.
EXCEPT AS PROVIDED IN THE LIMITED WARRANTY STATEMENT, AQUAM MAKES NO OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, AND THE WARRANTY STATEMENT IS IN LIEU OF ALL OTHER WARRANTIES, REPRESENTATIONS, PROMISES, OR CONDITIONS INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. AQUAM EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS NOT STATED IN THE PRODUCT'S LIMITED WARRANTY STATEMENT. ANY IMPLIED WARRANTIES AND CONDITIONS THAT MAY BE IMPOSED BY LAW ARE LIMITED IN DURATION TO THE APPLICABLE WARRANTY PERIOD. TO THE EXTENT ALLOWED BY LOCAL LAW, AQUAM'S LIABILITY FOR WARRANTY CLAIMS IS LIMITED TO REPAIR OR REPLACEMENT AS SET FORTH IN THE APPLICABLE LIMITED WARRANTY STATEMENT.
LIMITATION OF LIABILITYAQUAM MAXIMUM LIABILITY ASSOCIATED WITH THE PRODUCTS PURCHASED BY CUSTOMER SHALL NOT EXCEED THE TOTAL PRICE PAID BY CUSTOMER FOR THE PRODUCTS ORDERED BY CUSTOMER. IN NO EVENT SHALL AQUAM,ITS AFFILIATES, SUPPLIERS AND SERVICE PROVIDERS BE LIABLE TO CUSTOMER OR ANY THIRD PARTY FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOST PROFITS, OR THE LIKE), OR PUNITIVE DAMAGES, WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE AND PRODUCT LIABILITY) OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY A THIRD PARTY. AQUAM SHALL NOT BE LIABLE IF IT IS UNABLE TO PERFORM, OR IS DELAYED IN PERFORMING, ANY OF ITS OBLIGATIONS CONTAINED IN THESE TERMS AND CONDITIONS.
GOVERNING LAW AND JURISDICTIONThese Terms and Conditions shall be construed in accordance with the laws of the Province of Alberta and the laws of Canada applicable therein, without regard to principles of conflict of law, and the parties irrevocably attorn to the jurisdiction of the Courts of the Province of Alberta, Judicial District of Calgary. For greater clarity, this provision does not apply to the standards and guidelines that pertain to the installation and certification of Aquam products, as these will vary by jurisdiction.
